By accessing and using Appealingrange platform and services, you agree to use our services only for lawful purposes and in accordance with these Terms. You agree not to use our platform to:

• Legal Violations: Violate any laws, regulations, or third-party rights, including but not limited to copyright, trademark, privacy, and data protection laws
• Intellectual Property: Infringe on intellectual property rights of others, including copying, distributing, or using copyrighted materials without authorization
• Harassment and Abuse: Harass, threaten, intimidate, or harm other users, instructors, or staff members
• Malicious Software: Upload, transmit, or distribute malicious code, viruses, worms, trojans, or other harmful software
• Spam and Phishing: Spam, send unsolicited communications, or engage in phishing activities or other fraudulent schemes
• False Information: Impersonate others, provide false information, create fake accounts, or misrepresent your identity or qualifications
• Platform Security: Interfere with, disrupt, or damage the platform's security, functionality, or infrastructure, including attempting to bypass security measures
• Unauthorized Access: Attempt to gain unauthorized access to any part of the platform, other users' accounts, or our systems
• Course Materials: Copy, distribute, share, resell, or otherwise exploit course materials, videos, or resources without our explicit written authorization
• Automated Access: Use automated systems, bots, scrapers, or scripts to access or interact with the platform without our prior written consent
• Commercial Use: Use the platform for commercial purposes not authorized by us, including reselling access or creating derivative products
• Data Mining: Extract, scrape, or collect data from the platform for any purpose without authorization
• Reputation Harm: Engage in any activity that could harm our reputation, business operations, or relationships with partners or users

Consequences of Violation: Violation of these acceptable use terms may result in immediate termination of your account, loss of access to purchased courses, forfeiture of any fees paid, and legal action. We reserve the right to investigate violations and cooperate with law enforcement authorities.

Reporting Violations: If you become aware of any violation of these Terms, please report it to us immediately using the contact information provided below.

To the maximum extent permitted by applicable law, Appealingrange and its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Financial Losses: Loss of profits, revenue, data, business opportunities, or anticipated savings
• Substitute Costs: Costs of substitute services or products
• Service Interruption: Damages resulting from inability to access or use our services, including scheduled maintenance, technical issues, or force majeure events
• Data Issues: Damages resulting from unauthorized access to or alteration of your data, data loss, or corruption
• Third-Party Actions: Damages resulting from actions of third parties, including other users, service providers, or hackers
• Content Accuracy: Damages resulting from errors, inaccuracies, or omissions in course content or materials
• Career Outcomes: Damages resulting from failure to achieve specific career goals, job placements, or salary expectations
• Software Compatibility: Damages resulting from incompatibility between our platform and your device, browser, or software
• Any Other Damages: Any other damages arising from your use or inability to use our platform, even if we have been advised of the possibility of such damages

Limitation of Liability Amount

Our total liability to you for any claims arising from or related to these Terms or our services, whether in contract, tort (including negligence), or otherwise, shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or $100, whichever is greater.

Service Availability

We do not guarantee uninterrupted, secure, or error-free operation of our platform. We are not responsible for:

• Technical issues, bugs, or errors in the platform
• Server downtime, maintenance, or upgrades
• Data loss or corruption
• Internet connectivity issues on your end
• Compatibility issues with your device or browser
• Third-party service interruptions (payment processors, hosting providers, etc.)

No Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the services will meet your requirements or expectations
• Warranties that the services will be uninterrupted, timely, secure, or error-free
• Warranties regarding the accuracy, reliability, or quality of course content
• Warranties that defects will be corrected

Jurisdictional Limitations

Some jurisdictions do not allow the exclusion or limitation of certain damages or implied warranties, so some of the above limitations may not apply to you. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

If you are a consumer in the European Union, nothing in these Terms affects your statutory rights as a consumer.

Any disputes, controversies, or claims arising out of or relating to these Terms, our services, or your use of the platform shall be resolved through the following process:

Informal Resolution

Before initiating formal dispute resolution, you agree to first contact us at privacy@appealingrange.world to attempt to resolve the dispute informally. We will make good faith efforts to resolve the dispute within 30 days.

Binding Arbitration

If the dispute cannot be resolved informally, any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA). The arbitration shall be conducted in New York, New York, United States.

• The arbitration will be conducted by a single arbitrator selected in accordance with AAA rules
• The arbitrator's decision will be final and binding
• Arbitration proceedings will be confidential
• You waive your right to a jury trial and to participate in class action lawsuits

Exceptions

Notwithstanding the above, either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property rights or to prevent irreparable harm.

These Terms of Use shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law principles or provisions.

Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in New York County, New York, and you hereby consent to the personal jurisdiction and venue of such courts.

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

These Terms constitute the entire agreement between you and Appealingrange regarding your use of our platform and services, superseding all prior agreements and understandings.

We reserve the right to modify these Terms at any time. Material changes will be notified by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of our services after such modifications constitutes acceptance of the updated Terms.
